3. ELIGIBILITY: The “Find Santa in Atlanta” Contest is open only to Legal Georgia residents and U.S. Citizens age 13 and older who possess a valid state-issued ID and/or driver's license. Minors wishing to participate in this contest MUST be accompanied by a parent or legal guardian who must present a valid state-issued ID and/or driver's license. Employees of Cox Enterprises, Inc., Cox Radio, Inc., WBTS-FM, Atlanta area media, promotional sponsors, and all affiliated companies (and the immediate family members of all such employees, and all other with whom they are domiciled) are not eligible to participate in the contest or win prizes. The term immediate families include spouses, grandparents, siblings, children, and grandchildren. Only one winner per household per contest and winners may not win more than 1 contest every 90 days.
4. PRIZES: There will be one daily prize given out by the 95-5 The BEAT Santa each weekday, for a total of 17 daily prizes. WBTS-FM reserves the right to combine two or more of the following items in any combination to create one “daily prize” throughout the duration of the contest:

5. ODDS: The odds of winning a daily prize depend upon the number of people attempting to locate the “95-5 The BEAT Secret Santa” at any given time.

WINNER NOTIFICATION AND ACCEPTANCE: The first person to correctly locate and confirm the identity of the “95-5 The BEAT Secret Santa” by asking him “Are you the 95-5 The BEAT Secret Santa?” will win the daily prize that the “95-5 The BEAT Secret Santa” is carrying with him. Only one prize will be given out per weekday. Please see the following guidelines when locating and confirming the identity of the “95-5 The BEAT Secret Santa.”
• The “95-5 The BEAT Secret Santa” will remain stationary in a public area. Do not follow an individual who answers “Yes” to you, or who states that they are the “95-5 The BEAT Santa” to any location. Always stay in a public area.
• The true “95-5 The BEAT Secret Santa” will provide identification and possess a letter on 95.5 The BEAT Letterhead and signed by 95-5 The BEAT management.
• The “95-5 The BEAT Secret Santa” will only travel in the 95-5 The BEAT listening area, defined by the broadcast range of the station (excluding Internet streaming). For example, these areas include, but are not limited to the greater Atlanta metro area.
• Location clues will be given out every hour beginning December 1, 2008 at 8am and continuing until up until the “95-5 The BEAT Secret Santa” is found that day or until 7pm. The location of the “95-5 The BEAT Secret Santa” will change daily, and the Location clue will change daily as well. No clues will be repeated. For a list of previous daily clues, all eligible persons wishing to participate may visit www.955thebeat.com.
• The contest cannot be won outside of the designated operation hours. Monday through Friday, between 7am and 5pm.
• In order for a contestant to win they must approach the “95-5 The BEAT Secret Santa”, and say, (verbatim), “Are you the 95-5 The BEAT Secret Santa?” If it IS the “95-5 The BEAT Secret Santa”, the contestant will be shown a letter on station letterhead and signed by 95-5 The BEAT management.
• To receive the daily prize, the winner will be required to present a valid state-issued ID and/or driver's license. If the winner is under age 18, he/she MUST be accompanied by a parent or legal guardian who must present a valid state-issued ID and/or driver's license.
• In the event that more than one person approaches and correctly questions the “95-5 The BEAT Secret Santa,” the winner of the daily prize will be the person who asks first. If more than one person correctly asks at the same time, the daily prize will be divided equally between these people at the absolute discretion of the “95-5 The BEAT Secret Santa.” No correspondence or discussions will be entertained. The “95-5 The BEAT Secret Santa’s” decision is final.
• The “95-5 The BEAT Secret Santa” may not be approached while in a private residential home, a public restroom, or while in some form of transportation, whether stopped or in motion. Failure to follow these guidelines will result in disqualification for the remainder of the contest period.

Any one participant found searching on private land, or using private land to access or gain unfair advantage to the “95-5 The BEAT Secret Santa,” will be immediately disqualified. • Each day of the contest, there is only one person who has been appointed and nominated by 95-5 The BEAT as the “95-5 The BEAT Secret Santa.” 95-5 The BEAT may at its absolute discretion at any time replace the “95-5 The BEAT Secret Santa” with another person selected by station management.
• No destruction of private or public property or risk-taking is necessary to find the ““95-5 The BEAT Secret Santa.”
The Winner may waive his or her right to receive a prize. Prizes are non-assignable and non-transferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and WBTS-FM reserves the right to substitute prizes of equal or greater value.

WBTS-FM, and Cox Radio, Inc. reserves the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest. By participating, Contestants agree that Sponsor shall not be responsible for technical difficulties, malfunctions or failures of any kind, whether originating with contestant, Sponsor or a third party, including, without limitation, the malfunction of any telephone network or equipment. Sponsor is not responsible for any events beyond its control (acts of God, cancelled concert, artist or performer non-appearance, etc). Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor.
